These Terms of Service (“Terms”) are an agreement between you and Shield Pest Control Service (“Shield,” “we,” “our,” or “us”) for your use of shieldpestcontrolservice.us and any pages, forms, field notes, communications, and services that link to these Terms. By accessing or using the site, you agree to these Terms. If you do not agree, do not use the site.
These Terms affect your rights, including dispute-resolution and limitation-of-liability provisions. Please read them carefully. “You” means the individual using the site and, when applicable, the business or other entity that individual represents.
01 / ACCEPTANCE
Agreement and eligibility
By using the site, submitting a form, calling the number displayed on the site, or continuing to browse, you represent that you are at least 18 years old, have the legal capacity to enter this agreement, and will comply with applicable law. If you use the site for an organization, you represent that you are authorized to bind that organization.
We may update these Terms from time to time. The version posted on this page applies when you use the site. Material changes may be highlighted where appropriate. If you do not accept a revised version, your remedy is to stop using the site.
02 / USE LICENSE
Limited permission to use the site
Subject to these Terms, Shield grants you a limited, revocable, non-exclusive, non-transferable permission to access and use the site for your personal, non-commercial information and service-request purposes. This permission does not transfer ownership of any content.
- You may read, browse, and print reasonable excerpts for your own use.
- You may not copy, republish, sell, rent, lease, sublicense, distribute, frame, mirror, or commercially exploit the site or its content.
- You may not modify, reverse engineer, decompile, disassemble, or attempt to discover source code or security controls.
- You may not use the site to build a competing directory, dataset, service, or advertising product.
- You may not remove copyright, trademark, attribution, or other proprietary notices.
This permission ends automatically if you violate these Terms. Upon termination, stop using the site and delete copies obtained in violation of the Terms.
03 / USER OBLIGATIONS
Use the site honestly
You agree to provide accurate information, keep any contact information you submit current, and use the site only for a lawful purpose. Do not impersonate another person, misrepresent your affiliation, submit fraudulent or materially misleading information, or interfere with another person’s use of the site.
You may not upload or transmit malware, harmful code, spam, automated scraping requests, or content that violates another person’s privacy or intellectual-property rights. Do not use the site to request emergency, medical, legal, or other services that require immediate response. Call the appropriate emergency or public agency when safety is at issue.
If you consent to calls or text messages, you agree to provide a number where you can be reached and to update it if it changes. Reply STOP to an unwanted promotional text or HELP for assistance. Consent is not a condition of purchasing a service.
04 / REFERRAL RELATIONSHIP
What Shield does—and does not do
Shield operates this website as a free referral service to assist homeowners and property representatives in connecting with local service contractors. We may collect a request and share relevant information with an independent contractor or service provider that may contact you. Contractors are independent businesses, not employees, agents, partners, or joint venturers of Shield.
Shield does not perform the contractor’s work through this website, control an independent contractor’s schedule or methods, or enter into the service agreement between you and the contractor. You are responsible for reviewing the contractor’s identity, qualifications, licenses, insurance, price, scope, permits, and written agreement before hiring. Any service dispute should be directed first to the contractor involved.
For site privacy practices, read the Privacy Policy. For general questions, visit Contact; for context about the business, see About Us.
05 / DISCLAIMERS
Information is provided as-is
The site, its pages, field notes, forms, and content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Shield disclaims express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and suitability for a particular property.
Information on the site is general information, not a property inspection, diagnosis, emergency response, professional legal advice, or a promise that a particular result will occur. We do not guarantee that content is complete, current, error-free, or appropriate for your property. We may correct, remove, or change content at any time.
Shield does not warrant or guarantee work performed by an independent contractor. The homeowner is responsible for verifying that the hired contractor furnishes the necessary license and insurance required for the work being performed.
06 / LIMITATIONS
Limits on liability
To the fullest extent permitted by law, Shield and its owners, officers, employees, agents, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, loss of goodwill, or costs of substitute services, arising from or related to your use of or inability to use the site, content, communications, referrals, third-party links, or interactions with independent contractors.
To the fullest extent permitted by law, Shield’s total liability for claims arising from the site or these Terms will not exceed the greater of the amount you paid Shield for the applicable site service in the six months before the event giving rise to the claim or one hundred U.S. dollars. Some jurisdictions do not allow all limitations, so some provisions may not apply to you.
07 / REVISIONS AND AVAILABILITY
Changes to the site
We may add, remove, suspend, or modify features, pages, referral pathways, content, hours, or contact methods without notice. We may also suspend or terminate access if we believe a user violated these Terms, created risk, or misused the site. We are not required to keep every page, feature, or piece of content available.
Technical, typographical, photographic, or other errors may appear. We do not promise to update every item or maintain a particular publication schedule.
08 / LINKS
Third-party links and content
The site may link to third-party websites, maps, social networks, analytics services, contractor pages, or other resources. Shield does not control or endorse those sites and is not responsible for their content, availability, security, privacy practices, advertising, or transactions. Access them at your own risk and review their terms before using them.
09 / RELEASE
Release of claims
To the fullest extent permitted by law, you release and hold harmless Shield and its owners, officers, employees, agents, affiliates, successors, and assigns from claims, demands, damages, costs, and liabilities arising out of or related to your use of the site, a referral, an interaction with an independent contractor, third-party content, or a service agreement between you and a contractor. This release does not waive rights that cannot be waived under applicable law.
10 / DISPUTE RESOLUTION
Good-faith discussion and arbitration
Please read this section carefully. Before starting a court case or arbitration, the person raising a dispute must send written notice describing the issue and requested resolution to legal@shieldpestcontrolservice.us. The parties will try in good faith to resolve the dispute informally for 30 days.
Except for qualifying small-claims matters, intellectual-property or unauthorized-access claims seeking injunctive relief, and claims that cannot legally be arbitrated, any dispute arising out of or relating to these Terms, the site, or a referral will be resolved by final and binding arbitration on an individual basis. The arbitration will be administered by JAMS under its applicable consumer procedures, before one neutral arbitrator, in Los Angeles County, California, or another location mutually agreed by the parties. The arbitrator may award the relief available in court, but only for the individual claim.
Class-action waiver. You and Shield agree that claims may be brought only in an individual capacity, not as a plaintiff or class member in a class, collective, consolidated, or representative action. Unless both sides agree in writing, the arbitrator may not combine claims or conduct a representative proceeding.
Thirty-day opt-out. You may opt out of the arbitration and class-action-waiver provisions by emailing legal@shieldpestcontrolservice.us within 30 days after first accepting these Terms. Include your name, the email or phone number used with the site, and a clear statement that you opt out. If you opt out, the remaining Terms continue to apply.
11 / GOVERNING LAW
California law applies
These Terms and disputes arising from them are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to the arbitration section, courts located in Los Angeles County, California have exclusive jurisdiction, and you consent to personal jurisdiction and venue there. If a court finds a provision unenforceable, the remaining provisions remain in effect and the invalid provision will be narrowed to the minimum extent needed to make it enforceable.
12 / COPYRIGHT AND TRADEMARKS
Respect the work
Shield and its licensors own the site’s text, design, logos, visual assets, layout, trademarks, service marks, and other content unless a third party is identified. You may not use Shield marks or create a confusingly similar brand without written permission.
If you believe content on the site infringes your copyright, email legal@shieldpestcontrolservice.us with the page URL, description of the original work, your contact information, a good-faith statement, a statement that your information is accurate and that you are authorized to act, and an electronic or physical signature.
13 / GENERAL TERMS
Entire agreement
These Terms, together with the Privacy Policy and any additional terms presented for a particular feature, are the entire agreement about your use of the site. A delay in enforcing a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a business transaction. Headings are for convenience and do not change meaning. Notices may be sent to the email or postal address you provide or by posting on the site.
Questions about these Terms may be sent to legal@shieldpestcontrolservice.us or (424) 546-6002.
